MEGANITE INC.
Warranty with Ten-Year
Limited Liability Covered:
MEGANITE INCORPORATED hereby warrants to the original
residential and/or commercial purchaser of Meganite®
solid surface components and sinks to be free of manufacturing
defects for a period of (ten) years from the date of initial
installation. This warranty is in lieu of all other warranties,
express or implied, including the implied warranty of
merchantability or fitness or usage for a particular purpose.
MEGANITE INC. liability, hereunder is limited to the repair
or replacement of any defective material, at its sole
discretion including necessary and reasonable labor charges,
at the original site of installation. All repairs or replacements
hereunder are to be performed by MEGANITE INC. or it's
designated agents. Some states do not allow limitations
on how long an implied warranty lasts, so the above limitation
may not apply to you. Some states do not allow the exclusion
or limitation of incidental or consequential damages,
so the above limitation may not apply to you.
Not Covered:
MEGANITE INC. expressly disclaims any warranty of any
kind for residential or commercial use that is not fabricated
and installed by an Authorized Certified Fabricator or
Installer. It is the end user and customer's responsibility
to determine whether or not; a Meganite® Authorized
Certified Fabricator and Installer has performed all of
the fabrication and installation. The end user must advise
MEGANITE INC. or their designated agent in writing of
the purported defect prior to the expiration of the warranty
period. The end user must also furnish to MEGANITE INC.
or their designated agent the name and address of the
original Authorized Certified Fabricator. Defects or damage
determined by MEGANITE INC. or their designated agent,
at their sole discretion, to be the result of improper
fabrication or installation techniques, or inadequate
support or bracing material shall not be covered by the
MEGANITE INC. Ten-Year Limited Warranty and are the sole
responsibility of the Authorized Certified Fabricator.
The MEGANITE INC. warranty shall not apply to damage caused
by: 1. Failure to follow procedures recommended in the
MEGANITE INC. Technical Manual for transportation, storage,
handling, fabrication, or maintenance; 2. Physical abuse,
accidents or misuse; 3. Exposure to excessive heat; 4.
Failure of any adhesive, caulk, or other accessory or
failure of filled joints or seams; or 5. Improper installation.
This warranty does not apply to defects or damage resulting
from, alterations, tampering, chemical or physical abuse,
neglect, or normal wear and tear, or natural calamities
such as fire, flood, earthquakes, etc.
This warranty is extended only to the original purchaser
and may not be transferred or assigned. A purchase receipt
or other proof of date of original purchase will be required
before warranty service is rendered.
MEGANITE INC. neither assumes nor authorizes any person
or company to assume for us any other obligation or liability
in connection with our product. MEGANITE INC. will not
be liable in tort, contract, or otherwise, for any loss
or direct, consequential, incidental, or exemplary damages
arising out of the use or inability to use our product.
This warranty gives you specific legal rights and you
may also have other rights that may vary from state to
state or in Canada from province to province. To obtain
service under this warranty, contact the dealer from whom
you purchased your Meganite® Product. If satisfaction
is not obtained, write to our regional representative
at the following address, including a description of the
problem together with contact number.
